These Terms of Service (“Terms”) govern your access to and use of our WordPress themes, website, license activation API, and support resources. By installing, activating, or using our Products or services, you agree to these Terms.
1) Who we are

2) What these Terms cover
These Terms apply to:
- WordPress themes we publish (“Products”);
- Our website artemsemkin.com, documentation and demo sites we operate;
- Our license activation API used by theme setup wizards inside WordPress;
- Our support channels at Ticksy and support@artemsemkin.com.
3) Definitions
Products — WordPress themes we publish and sell.
License — The right to install and use a Product on a specified number of Sites, granted when you complete a purchase.
Sites — Production domains your License covers, as specified at checkout. Unlimited staging and development environments are always included at no extra cost.
Authorized Payment Partner — A third-party payment processor or merchant of record we designate to handle checkout and payment for direct purchases on artemsemkin.com. As of the effective date of these Terms, our Authorized Payment Partner is Freemius, Inc. (freemius.com).
Authorized Distributor — A third-party marketplace or platform authorized to sell our Products, such as Envato Market, WPBay, or Gumroad.
4) Purchasing and licensing
4.1 Direct purchases (artemsemkin.com)
Purchases made directly on artemsemkin.com are processed by our Authorized Payment Partner, who acts as the merchant of record. This means the Authorized Payment Partner is the legal seller on your receipt and is responsible for payment processing, tax collection and remittance worldwide. The charge on your statement will appear under the Authorized Payment Partner’s name.
Each Product sold through our direct store is also subject to a product-specific End User License Agreement (EULA) provided by our Authorized Payment Partner, available at checkout and on the product’s legal page. In the event of a conflict between these Terms and that EULA, the EULA governs for matters relating to the purchase transaction (payment, subscription mechanics, and intellectual property).
License tiers: Single Site (1 production domain), Multi Site (2 domains), Developer (5 domains), or Agency (20 domains). Unlimited staging and development environments are included with all tiers.
License duration: Licenses are available as a one-time lifetime purchase or an annual subscription that renews automatically. You will receive a reminder email before each renewal. You may cancel an annual subscription at any time; cancellation takes effect at the end of the current paid period with no refund for the unused portion.
4.2 Envato Market purchases
If you purchase a Product on Envato Market (ThemeForest), your purchase and license are governed by the Envato Standard License and Envato’s Refund Policy. Envato acts as the merchant of record for those purchases.
An Envato Standard License covers one production domain plus unlimited staging and test environments. Deactivating a domain releases that activation slot immediately. Updates remain available to Envato buyers for the lifetime of the item on Envato Market.
4.3 Authorized Distributors
We may make Products available through additional Authorized Distributors. Purchases from these platforms are subject to the distributor’s own terms of sale and refund policy, which govern the transaction. The same license scope and use restrictions described in these Terms apply regardless of where you purchased.
5) Refund policy
Direct purchases: We offer a 14-day Money Back Guarantee. If, during the first 14 days following your purchase date, you experience a defect that makes the theme’s material functions unusable, and following your cooperation with our support team we are unable to resolve it, you may request a full refund of the purchase price.
Refunds are not available for:
- Missing or desired features not present at the time of purchase;
- Incompatibilities or conflicts caused by third-party plugins, themes, or services;
- Discovering a competing or alternative product you prefer;
- Changing your mind;
- Subscription renewal charges (cancel before renewal to avoid future charges).
To request a refund, contact support@artemsemkin.com within the 14-day window with your order details.
Envato purchases: Refunds are governed exclusively by Envato’s Refund Policy.
Authorized Distributor purchases: Refunds are governed by the respective distributor’s refund policy.
6) Activation and license management
Activating a Product requires a valid license key or purchase code and may create or link an account on artemsemkin.com to manage your activations. Your License covers the number of production Sites specified at purchase. Deactivating a domain releases that activation slot.
We may suspend or revoke a license that is fraudulent, subject to a chargeback, or used in violation of these Terms.
7) Updates
Direct buyers: Product updates are available for the duration of your license entitlement — for the lifetime of the product for lifetime licenses, and for the duration of an active subscription for annual licenses.
Envato buyers: Product updates are available for the lifetime of the item on Envato Market. Activation may be required to access our update servers.
8) Support
8.1 Channels and response time
Support is provided via our Ticksy forum (requires a valid purchase code within its active support period) or by email at support@artemsemkin.com. Typical response time: within 2 business days.
8.2 Support period
Direct purchases: 6 months of support is included from the purchase date. A 12-month support extension is available for purchase.
Envato purchases: 6 months of support is included per Envato policy; renewals are handled by Envato.
8.3 What support includes
- Answering technical questions about theme features;
- Assistance with reported bugs and issues;
- Help with included third-party assets bundled with the theme.
8.4 What support does not include
- Customization or new feature development;
- Installation or server administration services;
- Conflicts caused by third-party plugins not declared compatible;
- Malware cleanup or performance tuning beyond our theme’s scope.
9) Acceptable use
You agree not to misuse the Products or services. Prohibited behavior includes, without limitation:
- Violating applicable laws or third-party rights (including intellectual property and privacy rights);
- Uploading or distributing malware or harmful code;
- Removing or obscuring proprietary notices or license information;
- Reselling, redistributing, or sub-licensing a Product except as permitted by the applicable license;
- Attempting to circumvent technical protections, activation, or licensing limits;
- Abusing our update or activation API (e.g., automated scraping or traffic that degrades service).
For Envato purchases, the Envato Market User Terms also apply.
10) Third-party services and compatibility
Our themes are designed for WordPress and commonly integrate with Elementor. Unless a plugin is explicitly listed as compatible in our documentation, compatibility is not guaranteed. Third-party services (such as Envato, Ticksy, hosting providers, CDNs, and email services) are operated by their respective owners under their own terms and policies.
11) System requirements
We recommend the latest stable versions of WordPress and Elementor, with PHP 8.1 or newer and a current MySQL or MariaDB release. We support the current and previous major versions of Chrome, Safari, Firefox, and Edge. Older environments may experience reduced functionality or performance.
12) Warranty disclaimer
THE PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. You are responsible for verifying compatibility with your environment and for keeping WordPress, plugins, and hosting up to date.
13) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PRODUCTS OR THESE TERMS WILL NOT EXCEED THE PRICE YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
14) Indemnification
You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Products or services, your violation of these Terms, or your violation of any applicable law or third-party rights.
15) Accounts and communications
Some features (such as license management) may require an account on artemsemkin.com. You are responsible for safeguarding your credentials and for all activity under your account.
We may send service communications (such as license, security, compatibility, or critical update notices). Marketing emails are sent only with your consent and can be unsubscribed at any time.
16) Age requirement
You must be at least 18 years old to purchase or use our Products or services.
17) DMCA / copyright notices
If you believe content on our site or within our Products infringes your copyright, please email me@artemsemkin.com with sufficient detail to identify the material and your rights.
18) Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new “Effective date.” For material changes, we will notify you through our documentation or within product updates. Continued use of the Products after changes take effect constitutes acceptance of the updated Terms.
19) Governing law and venue
These Terms are governed by the laws of the Republic of Armenia, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Products will be resolved in the courts located in Yerevan, Armenia.
Note: the EULA provided by our Authorized Payment Partner at checkout may specify a separate governing law and dispute resolution process for matters relating to your purchase transaction.
