We respect your privacy. This policy explains what we collect, why we collect it, who we share it with, and how you can exercise your rights when you visit our website, buy or activate a Product, contact support, or opt in to our emails.
1) What this policy covers
This policy applies to:
- Our website artemsemkin.com, our documentation and demo sites;
- Our license activation and update API used by theme setup wizards inside WordPress;
- Our customer account area and our support channels (Ticksy and email).
It does not cover the independent practices of the payment, marketplace, or service providers described in Section 4, who handle your data under their own privacy policies.
2) Data we collect
2.1 When you visit our website
- Analytics and attribution. With your consent, we use Google Analytics 4 to understand site traffic and measure purchases (for example, when a checkout begins and completes). Analytics and advertising storage are denied by default and only enabled after you accept them in our cookie banner (Google Consent Mode v2).
- First-party attribution cookie. We store a small, anonymous cookie recording how you first reached our site (source, medium, campaign, landing page). It contains no name, email, or account identifier.
- Consent preferences. We store your cookie banner choices so we don’t ask on every visit.
2.2 When you activate a license (inside your WordPress dashboard)
- Your license key or marketplace purchase code;
- Your site URL and technical environment (WordPress, Elementor, and theme/plugin versions, language/locale);
- Activation timestamps and the versions your sites report;
- Your IP address, used only transiently for rate limiting and abuse prevention (held in short-lived, hashed records that expire within minutes); we do not store it on your order or account.
2.3 When you purchase directly on artemsemkin.com
Direct checkout is operated by our payment partner and merchant of record (currently Freemius, Inc.), who collects and processes your name, email, billing details, and payment information as an independent controller for the transaction. We do not see or store your full payment details. From the completed purchase we receive and store your license key, order and product identifiers, billing cycle, and the email and name associated with your purchase.
2.4 When you create or link an account
To manage licenses and downloads we create an account that stores your email, a username, your display name, and your order and license records. For marketplace purchases that expose no real email (e.g. Envato), we generate an internal alias address (such as envato-username@artemsemkin.com) to attach your license; we don’t email aliases. When you provide a real email, we record your acceptance of these terms and this policy (with timestamps) and your marketing preference.
2.5 When you’re on our marketing list
If you opt in to marketing — or, outside regions where prior opt-in is required, when you purchase from us — we share your email address and (if available) your first name with our email provider (Kit / ConvertKit) to send you product news and offers. You can unsubscribe at any time, which stops all marketing.
2.6 When you contact support
If you open a ticket on Ticksy or email us, we process whatever you provide — your name, email, purchase code, message content, and any attachments — to answer you. When a support request is validated, we share your license validation result and support-window status with Ticksy.
3) Why we process your data (legal bases)
- To validate licenses, deliver updates and downloads, and keep your sites secure — performance of our contract with you and our legitimate interests;
- To create and operate your account and respond to support — performance of contract / legitimate interests;
- To send service emails about security, compatibility, licensing, or critical updates — legitimate interests;
- To send marketing emails — your consent where prior opt-in is required (which you can withdraw at any time), or our legitimate interest in keeping existing customers informed about product news and updates, always subject to a one-click unsubscribe. To set analytics/advertising cookies — your consent, which you can withdraw at any time;
- To prevent abuse and comply with the law — legitimate interests / legal obligation.
4) Who we share data with
We share data only with providers that help us operate our services, each under their own privacy policy and appropriate safeguards:
- Freemius, Inc. (United States) — payment processing and merchant of record for direct purchases;
- Envato — marketplace and merchant of record for ThemeForest purchases (purchase validation only);
- Google Analytics 4 (Google, United States) — website analytics, only with your consent;
- Kit / ConvertKit (United States) — marketing email delivery, only if you opt in;
- Ticksy — support ticketing, only when you open a ticket;
- Hosting and infrastructure providers — servers, storage, email delivery, and security.
We may also make Products available through additional authorized distributors (such as WPBay or Gumroad); purchases there are handled under those platforms’ privacy policies. We do not sell your personal information. Where data is transferred internationally, we rely on appropriate safeguards such as Standard Contractual Clauses.
5) Retention
- Cookies: the attribution cookie lasts up to 90 days; your consent preference lasts up to 180 days;
- Login links and rate-limiting records: minutes (they auto-expire);
- License and activation data: while your license is active and for up to 3 years after your last meaningful interaction;
- Support tickets: up to 3 years after closure unless the law requires longer;
- Order and customer records: retained as long as required to meet tax, accounting, and legal obligations.
We delete or anonymize data when it is no longer needed.
6) Your rights
Depending on where you live, you may have the right to access, correct, delete, or export your data, to object to or restrict certain processing, and to withdraw consent for marketing or cookies at any time. To exercise any right or request deletion, email me@artemsemkin.com from the address associated with your license, account, or ticket. Marketing emails also include an unsubscribe link. We do not knowingly process children’s data.
7) Cookies
We use a small number of first-party cookies for essential functionality, your consent preferences, and (only after you accept) anonymous attribution. Analytics and advertising cookies are set only with your consent via our banner. Our direct checkout provider also sets its own cookies during checkout for payment, security, and fraud prevention; you can review and opt out of those on the provider’s cookie policy. 8) Marketing emails and consent
Where the law requires prior opt-in (including the EU/EEA and the UK), we add you to our marketing list (product news and offers) only if you explicitly opt in — for example, by ticking the marketing box at checkout or subscribing on our site. Elsewhere, we may add you when you purchase from us or subscribe. Either way, every marketing email carries a one-click unsubscribe and we stop as soon as you use it. Service emails about security, compatibility, licensing, or critical updates may still be sent where permitted, as they relate to the Products you use.
9) Security
We use reasonable technical and organizational measures — access controls, encryption in transit (TLS), limited retention, and audit logging. No system is completely secure; please keep your WordPress, plugins, and hosting up to date.
10) Changes
We may update this policy to reflect changes in our services or legal requirements. We will revise the “Effective date” and, for material changes, highlight them in our documentation or within product updates.
